CYBERRY IT SOLUTIONS PRIVATE LIMITED and/or its subsidiaries, affiliates, and associates (hereinafter referred to as Superstrikers " or "We" or "Us" or "Our") provide products and/or services through the website/app, which is subject to the following terms and conditions (hereinafter referred to as "Terms", as well as the refund policy, etc. We strongly encourage all users to read our terms before using our services. Each user is bound by the terms, which can be accessed only when they comply with them at all times. All updated, modified, or the users must fully understand published terms. We will not be affected by the invalidity or unlawfulness of our terms if one or more judicial or quasi-judicial bodies in India determine that one or more are invalid or unlawful for any reason. We will still be able to enforce our remaining terms on all users, so this will not affect the validity of our remaining terms.

Anyone who does not accept our terms of service can or should stop using our website/app. Our clear and unambiguous intention is that users will grant unconditional, permanent and absolute consent to Superstrikers for the collection and use of information by the Website/App and its partners and affiliates as outlined in our Privacy Policy. A User has granted this permission to Superstrikers in writing by using the Website/App and its Services, and Superstrikers/Website/app must take no further action to obtain this permission from Users.

The Website/app and Terms may be modified at any time by us without prior permission.

The validity or enforceability of the terms will not be affected if any of the Terms are determined to be unlawful, invalid, void, or unenforceable for any reason whatsoever by any judicial or quasi-judicial body in India. You shall not be deemed to have waived Our right to act regarding any breach of the Terms by You by our failure or delay to act or exercise any such right or remedy.

Usage and Purpose

To register for certain Services on the Portal, Users will need to provide the following information:

• Restrict, suspend, or terminate a User's access to all or any part of the Platform;
• Reject, move, or remove any content a User submits;
• Delete or deactivate an account and all associated information and files;
• Identify general practices and limits relating to the use and access to Superstrikers;
• Adding or revising the roster of cricketers available to select in a Contest according to revisions to the match roster (defined here);
• The actual assignment of our rights and liabilities under these Terms to any entity will be notified to all Users via email or telephone.

Any User who breaches, reasonably believes that such User has breached, or illegally or improperly accesses, uses or accesses the Platform or participates in the Contest may, in its sole and absolute discretion, restrict, suspend or terminate the User's access to the Platform or Contests without notification to the User, delete or deactivate the User's Account and all associated information on it, delete any content posted by the User on the Platform, bar users from participating in contests, and take any other legal and technical steps necessary.

The Company will not be responsible for refunding any Platform Fee already paid for any Contest if the User breaches or violates these Terms. In addition, any wins (as defined herein) due to such Users and any win amounts credited to such Users will be automatically forfeited. Users may apply the balance to their accounts, excluding any accumulated wins, against losses and damages incurred or assessed by Us in case of a breach or violation of these Terms. Any remaining amount (if any) shall be returned to the User.

Applicability

Before registering, you are responsible for carefully reading and reviewing the terms provided on the Superstrikers site. These terms apply to all services offered on the website/app and product-specific conditions and rules applicable to specific products offered on the website/app. Fantasy cricket is one such product.

Eligibility

Users must meet the following criteria to use the application and play games on it:

• A registered user must hold an account on the application;

contests are charged service charges by Superstrikers. The service charges may vary depending on the nature of the contest. All taxes, including Goods & Services Tax, are included in the service charges charged by Superstrikers.

User Representations

You should provide accurate and complete information to us at the registration time or any subsequent time.

The user must ensure that playing contests in the jurisdiction they are accessing contests is legal before adding cash to the user account or participating in contests. The users are prohibited from participating in contests on the Website/app if they are not legally capable of entering into (indian's CURRENCY) transactions through India banking channels and/or do not access the Website/app from a jurisdiction that allows them to do so. If they violate these Terms, they will be prohibited from participating in contests, and you won't be entitled to any payouts on any wins you might win.

The user represents that they are 18 years or older and are competent to enter transactions with other users on the Superstrikers. They are aware of the facts and circumstances surrounding the Activity. They voluntarily participate in the Activity and assume all risks resulting from your participation, including all financial loss. Participation in the Activity will entitle them to indemnify and hold harmless Superstrikers its employees, directors, officers, and agents.

The Participant represents that they have the experience and skills necessary to participate in the Activity successfully. The Participant further represents that they do not suffer from any physical or mental condition that may affect their performance. Additionally, acknowledge that they are solely responsible for any consequences resulting from your participation in or being associated with this activity. Superstrikers does not assume responsibility for any financial loss incurred due to their participation in the Activity.

As a participant in a Game on the Website/app, you accept that we are not obligated to give you a win. As a player, you will win entirely based on your skill in relation to other players in the Game and your adherence to the Game's rules. You may incur financial losses if you participate in any of our games ("Activity").

Using the Website/app, you acknowledge and agree that you are solely responsible for posting, transmitting, uploading, or making any available content. You are responsible for legal ownership or licensing of all content you post. Any content you publish on our Website/app will be used, copied, reproduced, modified, adapted, published, edited, translated, derivative works created from, transmitted, distributed, publicly displayed, and publicly performed by us or our affiliates without charge. As a user, you understand that by viewing or using the Website/app, by availing of any Services or using communication features on the Website/app, you may be exposed to offensive, objectionable, or indecent content posted by other users. If you find offensive, objectionable, or indecent content posted by other users, you may bring it to our attention, and we reserve the right to take appropriate action. You are bound by the decision we make in this regard.

User Restrictions

You represent that you intend to play all Games you have registered/joined and will not use any form of external assistance to play any of them. Attempts to enlist such external assistance are strictly forbidden. We strictly prohibit any form of fraud, including adding cash to your user account with another person's credit card(s), debit card(s), net-banking username, password, authorization code, prepaid cash card, or mobile phone.

A user account belonging to another person cannot be accessed or attempted to be accessed through the Services.

Each player's winnings are unique and cannot be transferred. Any winnings that are attempted to be transferred will be forfeited

Transactions & Payments

Upon registering on our Website/app, we keep a record of all your transactions with us in your user account. You must log in to your Superstrikers account to make payments associated with contests. You will receive credit for all cash you win in this user account.

To Add cash to your user account, you must use an instrument you own to make a payment. For purposes of participating in contests on the Website/app, you may deposit as much money as you want in your user account, subject to the Add Cash limits specified by us occasionally.

Superstrikers encourages you to use the Website/app responsibly. Users can add cash to their user accounts subject to monthly cash limits, undertakings, indemnities, waivers and verification conditions as appropriate.

Payments are processed through third-party payment gateways, including credit cards, debit cards, and prepaid cash cards. Other payment methods require authorization from the intermediary that processes the payment. Payments will be processed solely according to their policies and procedures without any responsibility or risk on our part. We are not responsible for delays or denials at their end. In the "Complaints and disputes" section below, we provide a procedure for filing complaints if there are any issues with adding cash. Unless we are responsible in any way, we are not responsible if we delay or eventually decline your credit for reasons beyond our control. The winnings may be withdrawn electronically through an electronic bank-to-bank transfer. The following conditions apply to all withdrawals:

• Whenever needed, Superstrikers can request Know Your Customer (KYC) documents to confirm your address and identity. Only withdrawals from KYC-compliant accounts will be allowed.
• Withdrawing money from your user account is possible at any time, subject to win money withdrawal restrictions. There are withdrawal restrictions on promotional winnings, and you can only withdraw them after making a cash deposit and playing a contest.
• We may disburse the specified amount by electronic transfer once notified and after verification of the withdrawal request. The amount may also be disbursed to your user account using the financial instrument you used to add Cash.

Suspension and termination of accounts voluntarily

The Superstrikers expressly disclaims all liability and responsibility for any harm resulting from your participation in, or cancellation of, any game, any activities or transactions you have carried out with third parties through the Services, the Website, or the Software, or any User-generated Content, including any violation of intellectual property rights.

Intellectual Property

Regarding the Services, the Site, and the platform, as well as any content or information displayed or contained therein, all tangible and intangible rights, including copyright and other intellectual property rights, are exclusive to Superstrikers unless expressly stated otherwise. No failure of either party to insist on strict performance of any of the terms or provisions contained herein or exercise of any option, right, or remedy contained herein shall in the future be construed as a waiver or relinquishment of those terms, provisions, options, rights, or remedies, but such terms, provisions, options, rights, and remedies shall continue to apply and remain in force. There will be no waiver of any of these terms or provisions by either party unless it is in writing and signed by the other party.

The terms and conditions between the Parties relating to Superstrikers Website/apps and their use are contained in this document, excluding any prior terms and conditions.
